How the authorities at toll plaza on the Rourkela-Sambalpur Biju Expressway are looting the common man officially? We’ve been hearing the complaint regarding the toll tax collection at this toll plaza many times but the recent issue raised by S Pansari, who’s into transport business from a very long time.
How the official loot is taking place at Biju Expressway is explained by Mr. Pansari below. And if this thing is true then it’s not only a matter of shame only but proper investigation and probe should be ordered by the govt.
How the thing is taking place?
“As per Chapter-1 rule 2 sub-rule 21 of the Indian Motor Vehicles Act, 1988 define Light Motor Vehicle (LMV) as –“ a transport vehicle or omni bus the gross vehicle weight of either of which or a motor car or a tractor or road-roller the unladen weight of any of which, does not exceed 7,500 kilograms”.
As per Odisha Gazaette Notification of Works department sated 23rd June 2011 No. 6642-PPP.-39/2011 (Part-ii)W. IN page 3 explanation of classification of vehicles as stated as “car or jeep or van or light motor vehicle” means any mechanical vehicle the gross weight of which does not exceed seven thousand five hundred kilograms or the registered passenger carrying capability as stated in the certificate of registration issued under Motor Vehicles Act, 1988 does exceed twelve excluding the driver”.
This clearly indicates that Goods Vehicle like TATA 407/Eicher 1049/1059 type of vehicles which have GVW less than 7500KG are LMV and should be charged toll as per LMV category of CLASS-3 as per toll category. I recently observed that Plazas at Biju expressway are charging my vehicles as per LCV or Class-4 category. When I raised the matter with with the Sambalpur toll plaza office they did accept the fact but off the records told me to keep quite about it and the classification for my vehicle will be changed in their system. Please find attached the RC copy of my vehicle OD15K7522 with toll slips of all the 3 toll plazas. If you notice sambalpur toll plaza mention class of vehicle as type 3 in their slip where as other plazas of Sundergarh and Rajgangpur continue to classify it as CLASS-4. In the RC copy please note that Registered laden weight is 4995 kg. As per Motor Vehicle Act this is a LMV but are being charged as per LCV.
Now, I have another vehicle which is of the exact same model OD15K5644. PFA the RC copy and the toll slips. Here all three toll plazas are categorizing this as Class-4 where as this is also a vehicle with Registered laden weight is 4995 kg and hence a LMV.
The Biju Expressway toll plaza are blatantly duping unaware public of Rourkela and Sambalpur by overcharging a certain category of LMV as LCV. Practically any transport/commercial vehicle with 4 tyres have registered laden weight below 7500 KG. Public is unaware of this law and are being exploited.”
Now the question is why the particular vehicle’s class changed in the system and officials told to keep quiet about it? Why the Type-3 vehicles are getting overcharged with Type-4 price?
If you remember, on 2nd April 2018 a forum has termed the toll collection as ‘illegal and arbitrary’ and called for a strike to suspend toll collection from the expressway. The expressway has been into controversy since the day of its inauguration on March 13 in all the three districts – Sambalpur, Jharsuguda and Sundargarh of west Odisha.
